Terms of Service

1. About these terms
These Terms of Service ("Terms") govern your access to and use of the yourturn guest operations platform, available at useyourturn.com and app.useyourturn.com(the "Service"), operated by yourturn ("we," "us," or "our").
By using the Service - whether as a restaurant operator or as a guest joining a waitlist or booking a reservation - you agree to these Terms. If you do not agree, do not use the Service.
For standard self-serve subscriptions, these Terms and the acceptance flow in signup and checkout form the agreement between you and yourturn unless we separately agree otherwise in writing.
2. Definitions
- Operator - a restaurant, business, or individual who creates a yourturn account to manage guest waitlists and reservations
- Guest - a person who joins a waitlist, books a reservation, or manages a reservation through the Service
- Reservation contact - the single guest contact submitted for a reservation and used for reservation updates and management links
- Platform - the yourturn web application, APIs, and related services
3. Operator accounts
3.1 Eligibility
You must be at least 18 years old and authorized to act on behalf of the business to create an operator account. By creating an account, you represent that this is the case.
3.2 Account security
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at support@useyourturn.com if you suspect unauthorized access.
3.3 Acceptable use
Operators agree to use the Service only for lawful waitlist and reservation management purposes. You must not:
- Use the platform to send unsolicited marketing messages to guests
- Collect guest information beyond what is needed for waitlist or reservation management
- Attempt to reverse-engineer, scrape, or disrupt the Service
- Share your account credentials with unauthorized users
- Bundle marketing consent into transactional waitlist or reservation acknowledgments
- Use the Service in any way that violates applicable law, including the TCPA, CASL, PIPEDA, carrier rules, or other messaging regulations
3.4 Operator responsibility for guests
Operators are responsible for ensuring that guests are informed that their information will be used to manage the waitlist or reservation and that transactional SMS or email messages may be sent. This may include name or party name, phone number, reservation email address, party size, reservation details, optional occasion, notes, replies, wait estimate, and visit outcome. yourturn provides the disclosure text on the join form, kiosk flow, and online reservation forms, including Terms and Privacy acknowledgment near submit where used; operators must not remove, obscure, or misuse it.
Operators may not use guest phone numbers or email addresses collected through the Service for unrelated marketing or promotional messaging through the platform.
4. Guest use
By joining a restaurant's waitlist or booking a reservation through yourturn, you:
- Acknowledge these Terms and our Privacy Policy when that disclosure is presented near submit
- Consent to receive transactional SMS messages and/or transactional reservation emails about your visit, including join confirmations, reservation confirmations, reminders, table-ready alerts, cancellation handling, and replies related to your visit
- Understand that your name or party name, phone number, reservation email address, party size, reservation details, optional occasion, notes, replies, wait estimate, and visit outcome may be shared with the restaurant whose waitlist or reservation you submitted
- May opt out of SMS messages at any time by replying STOP or request help by replying HELP
- Understand that reservation updates are sent only to the single booking contact submitted for that reservation
- Understand that standard carrier message and data rates may apply
Guest use of the Service is provided as a convenience. yourturn does not guarantee seat availability, specific wait times, reservation availability, or that any restaurant will honour a waitlist position or booking request.
5. Transactional messaging terms
yourturn sends transactional waitlist SMS messages and reservation communications on behalf of the restaurant you joined. This program is limited to visit-related communications such as join confirmations, reservation confirmations, reservation reminders, table-ready alerts, status links, manage links, cancellation handling, and help or reply messages triggered by your interaction with the Service.
Message frequency varies based on your visit and interaction with the Service. Most guests receive one waitlist confirmation and one table-ready alert, or a reservation confirmation and reminder, plus any reply or help messages they request or trigger.
Message and data rates may apply to SMS. Reply STOP to opt out and HELP for help. Consent to receive these transactional messages is not a condition of purchase.
Reservation emails or manage links may include links to review the booking, see the menu, get directions, or message the restaurant where supported. We do not use this guest messaging program for marketing or promotional communications, and reservation acknowledgments are not bundled with marketing consent.
6. Fees and billing
yourturn offers paid service tiers, including Basic at C$39/month or C$390/year and Pro at C$69/month or C$690/year. All listed prices are in Canadian dollars (CAD). Basic currently includes 1,000 SMS per month and Pro currently includes 2,500 SMS per month, including on annual plans. Additional SMS usage is billed at C$0.03 per SMS.
Not every feature is available on every plan. Basic includes the core digital waitlist and a flat default wait estimate. Pro includes premium features such as TurnIQ wait estimates, host replies, custom guest messaging, customer history, advanced analytics, business-hours controls, live floor-map tools, and online reservations with optional occasion capture, confirmation links, and reservation guest emails. Reservation reminder texts or emails, table assignments, and multi-table workflows may vary by restaurant configuration.
Paid subscriptions and related billing are processed through Stripe or another payment processor we designate. By starting a paid subscription, you authorize recurring charges to your selected payment method until the subscription is canceled.
We may offer a free trial before the first paid billing period begins. If you subscribe during a free trial, your subscription stays in a free trial until the stated trial end and then converts into the selected paid billing cycle unless you cancel before the trial ends.
Subscriptions renew automatically each billing period unless canceled. If you cancel, your subscription generally remains active through the end of the current paid billing period, and changes between plans may take effect immediately or on your next billing date depending on the billing flow shown in Stripe or the Service.
All fees are in Canadian dollars unless stated otherwise. Taxes may apply where required by law. Except where required by law, fees and usage charges are non-refundable, and we do not provide prorated refunds or credits for partial billing periods, partial months, downgrades, or unused Service. We reserve the right to change pricing or plan packaging with reasonable notice.
7. Early access and beta features
Some features may be identified as beta, early access, or otherwise still evolving. Those features are optional and may change, be interrupted, or be removed at any time.
Beta features may be incomplete, may not work in every scenario, and are excluded from any uptime, support, or feature-availability commitments unless we say otherwise in writing.
Operators remain responsible for using operational judgment when relying on beta workflows during live service, including reservation pacing, table assignment, guest communication, and staffing decisions.
8. Intellectual property
The yourturn name, logo, and all content on the platform are the property of yourturn and are protected by Canadian and international intellectual property law. You may not use our trademarks or branding without written permission.
Operators retain ownership of their restaurant data (names, settings, party records). By using the Service, you grant yourturn a limited license to process and store that data to provide the Service.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
11. Limitation of liability
To the maximum extent permitted by applicable law, yourturn shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages. Our total liability in any matter arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 CAD, whichever is greater.
12. Indemnification
Operators agree to indemnify and hold harmless yourturn, its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or for any other reason with reasonable notice. You may close your account at any time by contacting us at support@useyourturn.com. Upon termination, your data will be handled in accordance with our Privacy Policy.
14. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be resolved in the courts of Ontario, Canada.
15. Changes to these terms
We may update these Terms from time to time. We will post the revised version on this page with an updated effective date. If changes are material, we will notify operator account holders by email at least 14 days in advance. Continued use of the Service after changes constitutes acceptance of the revised Terms.
